1. Terms and Acceptance
These terms of use (the "Terms") govern access to and use of unwrittentravel.com (the "Site") by any person who accesses, browses or interacts with it (the "User"). The Site is owned and operated by Voyages Unwritten inc., operating under the brand Unwritten Travel ("Unwritten Travel", "we", "us" or "our"), based in Québec, Canada.
Please read these Terms before using the Site. If you do not agree to them, please discontinue use of the Site. These Terms apply subject to applicable law, including mandatory consumer protections and language rights. They govern use of the Site and do not replace a separate client agreement for travel services.

2. Functions of Unwritten Travel
The Site presents our travel advisory services and allows you to submit an inquiry through a TravelJoy-powered form embedded on the Site or schedule a discovery call. No payment or travel reservation is completed on the Site. Submitting an inquiry, exchanging preliminary information or scheduling a call does not confirm a booking or engage paid planning services.
We provide travel advisory services as an independent advisor affiliated with Travel Edge (Canada) inc., our host agency. Travel arrangements may be booked with a variety of third-party suppliers, including hotels, airlines, cruise lines, tour operators and destination management companies. The relevant suppliers and applicable booking terms will be identified in the documents provided to you before you confirm a booking.
Any paid planning engagement or booking is subject to a separate client agreement and applicable supplier conditions. Fees, payment obligations, cancellation conditions and the roles of the relevant parties will be explained through that process. The involvement of a host agency or a supplier does not remove our own obligations under applicable law.

3. Third Party Links
The Site may contain hyperlinks redirecting to third-party websites (the "Links"). We do not control the content or availability of those websites. Their own terms and privacy policies may apply when you visit them or use their services.
No link redirecting to this Site may be posted on websites distributing illegal content or violating applicable laws. We may require removal of a link that falsely suggests an endorsement or affiliation, infringes our rights or facilitates unlawful use. Nothing in this section excludes responsibility that cannot legally be excluded.

4. Modification of Terms
The Terms may be modified from time to time by Unwritten Travel. Changes take effect prospectively from the date of the revision indicated at the beginning of these Terms, subject to any notice required by law. We will make the revised version available on the Site. Changes do not modify an existing client agreement or booking.

5. Intellectual Property
All elements available on this Site, including text, photographs, images, videos, graphics, trademarks, logos and other content (collectively, the "Materials"), are protected by applicable copyright and intellectual property laws, whether Canadian or international. The Materials are owned by Voyages Unwritten inc. or used with permission from their respective rights holders.
No transfer of intellectual property rights, implied or explicit, is granted to the User. The display or availability of the Materials does not transfer those rights or grant a licence to reuse the Materials.
You may browse and view the Materials for personal, non-commercial purposes. Except as permitted by applicable law, any reproduction, distribution, modification, publication, reposting or other reuse of the Materials requires prior written permission from us or the relevant rights holder.

6. Privacy Protection
We handle personal information in accordance with applicable privacy law, including Québec’s Act respecting the protection of personal information in the private sector. Our separate Privacy Policy explains our practices concerning the Site, inquiries and related discovery appointments, including tools used for these purposes.
We obtain consent where required and use reasonable protective measures appropriate to the information concerned. Reading these Terms or our Privacy Policy does not constitute blanket consent to every use or disclosure of personal information.

7. Interactions
When communicating with us through the Site or related inquiry tools, you must not send unlawful, fraudulent, threatening, hateful, discriminatory, defamatory or abusive content; infringe another person’s privacy or intellectual property rights; send malicious code; or use these tools to send spam or solicit information unlawfully.
Private inquiries and communications do not become public contributions. Sending us a message does not transfer ownership of it, waive your moral rights or authorize public distribution. We will obtain appropriate permission before publishing an identifiable testimonial, photograph or client story.
Please do not submit passport copies, payment card details or sensitive health information through the initial inquiry form. If such information becomes necessary for a travel file, we will explain the purpose and the appropriate way to provide it.

8. Permitted Uses
Unwritten Travel grants you a personal, limited, non-exclusive and non-transferable licence to access and view the public content of the Site solely for private, non-commercial purposes and in line with the Site’s objectives. Any use of the Site must comply with applicable laws and these Terms. This licence does not grant permission to reuse the Materials beyond section 5.
The Site may integrate or link to third-party applications, including TravelJoy and Calendly. Related discovery calls may take place through Google Meet. Providers’ terms and privacy notices may apply to their services. Please review them when using those services.

9. Prohibited Uses
You must not integrate or display Site materials on another platform in a way that conceals their origin or misleads users; systematically download or scrape content without authorization; remove copyright notices; or reuse the Materials contrary to section 5. This provision preserves uses permitted by applicable law.
You must not attempt unauthorized access, impair the Site’s operation, introduce harmful code or use the Site for abusive, fraudulent or unlawful activities. We may restrict access as reasonably necessary to address such conduct.

10. User Warranties and Representations
When submitting an inquiry, you agree to provide accurate information and to have the necessary authority to share another person’s personal information or act on their behalf. You must have the legal capacity required to enter into any subsequent client agreement. An adult with appropriate authority must arrange services for minor travellers.
Please communicate responsibly and respect appointment arrangements. If we propose recording or transcribing a discovery call using Fathom, we will explain the purpose and obtain your consent before doing so. You may decline and proceed with a call without recording or automated transcription.

11. Suspension or Limitation
We may suspend or limit access to all or part of the Site for maintenance, security reasons or to address a violation of these Terms or applicable law. This may include changes to content or available Site functions. We do not promise uninterrupted access.
A restriction on Site access does not cancel a booking or change your rights under a separate client agreement.

12. Termination
You may cease using the Site at any time. We may terminate your permission to use the Site if you violate these Terms or applicable law. Provisions that, by their nature, should survive termination continue to apply to the extent permitted by law. We reserve the right to seek appropriate legal remedies.

13. Disclaimer of Warranties
We take reasonable care in presenting information on the Site, but we do not guarantee that all general information will always be complete, current or free of errors, or that the Site will operate without interruption or technical issues.
Destination descriptions and photographs illustrate possible experiences. Availability, prices, supplier offerings and entry requirements may change. Site content is not a confirmed offer or reservation. Before you book, the relevant details and conditions will be provided through the client engagement process. Consult the appropriate official authorities for current passport, visa, health and entry requirements.
Any disclaimer in these Terms applies only to the extent permitted by law. Legal warranties and other protections that cannot be excluded remain applicable.

14. Limitation of Liability
Nothing in these Terms excludes or limits liability where prohibited by law. In particular, these Terms do not exclude liability for bodily or moral injury, material injury caused by intentional or gross fault, or the consequences of our own acts where protected by consumer law.
The respective obligations of Unwritten Travel, Travel Edge (Canada) inc. and travel suppliers in a paid engagement are addressed in the applicable client and booking documents, subject to mandatory law. These Site Terms do not impose a monetary cap on a consumer’s non-waivable remedies.

15. Responsibility for Misuse
You remain responsible, in accordance with applicable law, for harm caused by your unlawful use of the Site or infringement of another person’s rights. These Terms do not require you to indemnify us for our own fault or waive any mandatory consumer protection.

16. Applicable Laws
These Terms and access to the Site are governed by the laws in force in Québec and the federal laws of Canada applicable there, subject to any mandatory protections applicable to you. A dispute may be brought before a court that has jurisdiction under applicable law. No exclusive judicial district or mandatory arbitration is imposed by these Terms.
These Terms are available in French and English on the Site. Where applicable law requires the French version to be provided before you expressly choose another language, we comply with that requirement. Nothing in these Terms limits any language rights that cannot be waived under applicable law.
